As stipulated by Act No 106/1999 Coll., on the Provision of Information

Appeal from refusal of a request for information

An appeal from the decision of the State Institute for Drug Control to decline a request for information pursuant to Act No  106/1999 Coll. may be filed with the State Institute for Drug Control within 15 days of the notification of the decision to the applicant. The appeal shall be decided by the Ministry of Health within the period of 15 days of the submission of the applicant's appeal together with the file by the State Institute for Drug Control which shall be made within 15 days of the delivery of the appeal. The appeal cannot dispute the rationale of the decision to decline the request, but only the ruling part of the decision.

What an appeal must contain

  1. Name of the applicant (person filing the appeal); 
  2. Identification of the State Institute for Drug Control;
  3. Identification of the decision disputed by the appeal;
  4. Where the applicant finds grounds for a breach of law, and where he/she finds the decision or preceding procedure to be incorrect;
  5. What the person filing the appeal claims;
  6. Signature of the person filing the appeal.

Methods of submitting an appeal

In writing

  1. By post to the following address:

  2. Personally, in the mail room of SÚKL (at the same address as the one specified for postal delivery),
  3. Via electronic mail room at posta@sukl_cz with a certified electronic signature.

Orally to protocol An oral appeal may be lodged at the same address of the Institute as that for postal delivery or at any Regional Control laboratory (OKL) of SÚKL.

Complaint regarding the procedure of handling a request for information

An appeal from the procedure employed in the handling of a request for information may be filed with the State Institute for Drug Control in compliance with the procedure stipulated by the provisions of Section 16a of Act No  106/1999 Coll., within the period of 30 days of the date of:

  1. delivery of the notice in which the State Institute for Drug Control refers the applicant to published information;
  2. delivery of the notice in which the State Institute for Drug Control suspends the application for lack of powers to provide the information;
  3. delivery of the notice in which the State Institute for Drug Control notifies on the requirement to reimburse the costs of provision of the information;
  4. expiry of the period for the provision of information, if the request has not been declined by way of decision;  
  5. expiry of the period for the provision of information within an extended period of time pursuant to the provisions of Section 14, paragraph 7 of Act No  106/1999 Coll., if the request has not been declined by way of decision.

Where the State Institute for Drug Control does not fully grant the complaint within 7 days, the complaint shall be decided by the Ministry of Health. The Ministry shall issue its decision within the period of 15 days of the date of its submission by the State Institute for Drug Control.
