Acting in compliance with Section 39n(1) of Act No. 48/1997 Coll., on Public Health Insurance, as amended (“Act”), the State Institute for Drug Control publishes the List of Prices and Reimbursements for Medicinal Products and Foods for Special Medicinal Purposes Covered by the Public Health Insurance Scheme (“List”). The List, published on the 1stday of the calendar month, includes a full list of medicinal products (MPs) and foods for special medicinal purposes (FSMPs) covered by the public health insurance scheme that are reimbursed by decision of the Institute, including the maximum or announced ex-factory prices, the amount and terms of reimbursement, incl. the maximum possible reimbursement for the end consumer, and the supplementary payment in the eligible limit.
In addition, the List contains basic reimbursements of reference groups, explaining how the basic reimbursements were set, along with a full list of medicinal products and foods for special medical purposes classified in the reference groups, and the maximum prices of medicinal products and foods for special medical purposes where the Institute has the power to make decisions on the maximum price, and a full list of medicinal products and foods for special medical purposes with an explanation how the maximum prices were set.
Effective from 16 April 2012 and enforceable from 16 May 2012, judgment of the Municipal Court in Prague 11 Ad 13/2010 – 104 dated 12 April 2012 in the legal case of the Plaintiff, Zentiva a.s., ID No. (IČ) 31411771, having its registered office at Nitranská 100, Hlohovec, Slovak Republic, against the Defendant, Ministry of Health of the Czech Republic, having its registered office at Palackého náměstí 4, Prague 2, launched by the Plaintiff's lawsuit against decision of the sued administrative authority dated 13 April 2010, ref. no. MZDR 5232/2010, file no. FAR: L19/2010, whereby the Ministry of Health confirmed decision of the Institute dated 30 December 2009, ref. no. SUKLS6016/2009, in the joint administrative proceedings on the amended amount and conditions of reimbursement of medicinal products that have in essence interchangeable therapeutic effects as medicinal products belonging to reference group no. 28/2 hypolipidemics, fibrates; per os, contained the following award: the above decision of the Ministry is cancelled, and the case is remanded to the Defendant for further proceedings. The foregoing is reflected in the List published by the Institute under Section 39n(1) of Act No. 48/1997 Coll., on Public Health Insurance and on Amendments and Supplements to Some Related Acts.
